THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.40714 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in not reviewing the adequacy of the petitioner's security deposit by taking preceding 12 months period i.e., from April, 2015 to March, 2016 as basis for the consumption year 2016-17, as highly illegal and arbitrary. 2.

Heard both sides. On 25.11.2016 this Court passed the following interim order:

" ... Respondents are directed not to disconnect the power supply to petitioner unit, for non-payment of additional consumption deposit demanded in the impugned notice, for a period of three (3) weeks from today subject to the following conditions:

(a) Petitioner makes on account payment of a sum of Rs.30,00,000/- (Rupees Thirty Lakhs only) within ten (10) days from today and a further sum of Rs.35,00,000/- (Rupees Thirty Five Lakhs only) on or before 15.12.2016.

(b) If the petitioner commits default of any one of the conditions, it is open to respondents to proceed in the matter in accordance with law."

Sri R.Vinod Reddy, the learned Standing Counsel for TS TRANSCO, submitted that the petitioner has not complied with the orders of this Court.

Learned counsel for the petitioner did not dispute the same.

In view of the non-compliance of the interim order of this Court, no further orders are necessary in this writ petition. 6.

Hence, the Writ Petition is closed. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
