THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.3733 OF 2009 ORDER:

This Writ Petition is filed by the petitioner seeking to declare the action of the respondents in not giving work order for execution of the work relating to laying of C.C. Road from Gangadhar Mallaiah (H) to T. Shanker (H) in Ananthapalli Village, Boinpally Mandal, Karimnagar District allotted in favour of the petitioner vide Proceedings dated 30.01.2009 in No. DB5/ IDI CCR & CCD/ 09 by the 2nd respondent pursuant to the order dated 22.12.2008 in proceedings No.Plg.II/ 504/ 07/ JGL issued by the 1st respondent and also to declare the action of the respondents in changing the work relating to laying of CC Road from Gangadhar Mallaiah (H) to T. Shanker (H) in Ananthapalli Village, Boinpally Mandal, Karimnagar District to different village, as illegal and arbitrary."

When the matter is taken up for hearing, learned counsel for the petitioner submitted that while admitting the writ petition on 03.03.2009, this Court passed the following order in WPMP No.4862 of 2009:

" The petitioner has been entrusted with the erection of the work vide proceedings dt.30.01.09 by the Executive Engineer, Panchayat Raj Department, Jagtial. At this stage, the work cannot be cancelled. There shall be interim direction as prayed for" , and in view of the same, no further orders are required in the matter.

Accordingly, the Writ Petition is disposed of in view of the interim order passed by this Court on 30.01.2009 WPMP No.4862 of 2009. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
