HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CRIMINAL PETITION NO. 3074 OF 2015 ORDER:

This application is field under Section 482 Cr.P.C to call for the records relating to Crime No. 88 of 2014 on the file of Mancherial Police Station, Adilabad District and to quash the same. Petitioners are accused 1 to 8 in the said case and they alleged to have committed offences punishable under Sections 120B, 420, 465, 447, 506 read with 34 IPC. The second respondent had lodged a complaint on 24.3.2015 alleging that the petitioners had tried to dispossess her from the land belonging to her and they had also threatened to kill her unless she vacates the land. Since the allegations in the complaint make out a case against the accused and the question whether the accused possess title to the land or not, cannot be gone into at this stage, I am of the opinion that this is not a fit case to entertain this application under Section 482 Cr.P.C and quash FIR. However, the S.H.O of Mancherial Police Station, Adilabad District, is directed to follow the procedure contemplated under Section 41-A Cr.P.C in so far as petitioners /accused are concerned.

Accordingly, the Criminal Petition is dismissed with above observation.

As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
