THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.5327 OF 2005 ORDER:

This Writ Petition is filed seeking a writ of mandamus declaring the action of the first respondent in appointing respondent Nos.2 to 6 as non-hereditary trustees on 14.02.2005 as illegal, arbitrary and violative of Article 14 of the Constitution of India.

The first petitioner is a hereditary trustee of the temple by name Koganti Ramaswamy Trust Board, Kuchipudi Village and respondent Nos.2 to 6 were appointed as non-hereditary trustees by a notification and a news item was published in news paper on 20.02.2005 based on the said notification. The present Writ Petition is filed contending that appointment of respondent Nos.2 to 6 as non-hereditary trustees is illegal.

As seen from the news item published in news paper, respondent Nos.2 to 6 were appointed as non-hereditary trustees for a period of five years, which tenure has already been expired long back. Therefore, the cause of action does not survive and the Writ Petition has become infructuous.

Hence, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
