With the consent of the learned Counsel for the parties, we have taken the present writ petition for disposal. 2.

The petitioner filed this writ petition challenging the action of the respondents in not considering his case for promotion to the post of Deputy Executive Engineer though he is fully eligible and entitled for promotion and placed at Serial No.2 in the final seniority list of MAEs/MAEEs/MAE(Elec) of Zone I & II dated 18.4.2017, on the ground that disciplinary proceedings are pending against him.

Since the case of the petitioner comes under G.O.Ms. No.257, dated 10.6.1999, we hereby set aside the order dated 22.11.2017 passed by the A.P. Administrative Tribunal in O.A.No.3083 of 2017. Consequently, we direct the respondents to consider the case of the petitioner for promotion in terms of G.O.Ms.No.257, dated 10.6.1999.

Accordingly, the Writ Petition is allowed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
