THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.35632 OF 2015 O R D E R :

In this Writ Petition, petitioner challenges suspension of his fair price shop authorization done vide proceedings No.RC.B/2801/2015, dt.22.09.2015 of the 3rd respondent.

2. Heard counsel for the petitioner and Government Pleader for Civil Supplies representing respondents 1 and 5.

3. Admittedly, petitioner had preferred an appeal No.D1/107/2015 against the impugned proceedings to 5th respondent.

4. Since there is an effective alternative remedy in the form of appeal to 5th respondent against the impugned proceedings and which remedy had already been availed by the petitioner, 5th respondent is directed to decide the appeal filed by the petitioner within a period of four (04) weeks from the date of receipt of a copy of this order and pass a reasoned order after hearing the petitioner. The petitioner is entitled to raise all contentions open to him at law.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.

6. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
