THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.30405 OF 2016 ORDER:
The writ petition is filed seeking a writ of mandamus to declare the action of the second respondent in preventing the petitioners to use the only way which is on the eastern side for ingress and egress to Sri Satyavathi Kalyana Mandapam, Venkatagiri Town, SPSR Nellore District amounts to erroneous and arbitrary, and consequently direct the second respondent not to obstruct the petitioners to ingress and egress of the said Kalyana Mandapam.
Heard and perused the material.
Learned counsel for the petitioners submits that the petitioners are the owners of the Sri Satyavathi Kalyana Mandapam and that the said Kalyana Mandapam is bounded East by road, which is the only way for ingress and egress and that there is no other way to reach the Kalyana Mandapam. He further submits that the second respondent is instigating the third parties to object the way to Kalyana Mandapam and as such, prays this Court to direct the second respondent not to object the way to reach Kalyana Mandapam.
Learned counsel for the second respondent submits that they are not objecting to use the only way to the Kalyana Mandapam and that they are not instigating any other persons to object the said way. Recording the submission of the second respondent, the writ petition is disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of.
