Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents. 2.

Petitioners claim that lands in Sy.No.89 to an extent of Ac.0-15 guntas, Ac.0.15 guntas, Ac.0.15 guntas, Ac.2.20 guntas, Ac.2.20 guntas, Ac.0.20 guntas respectively, situated at Lothukunta Village, Valigonda Mandal, Yadadri Bhuvanagiri District, was assigned to the petitioners long ago and ever since they are in possession and enjoyment of the said lands. Petitioners 2 to 5 belong to Backward Class (Kurma community) and petitioners 6 and 7 belong to Scheduled caste community. Petitioners now allege that the respondent authorities have inspected the lands and are now seeking to dispossess them and to allot the land for the purpose of Sangeeka Sankshema Balikala Gurukula Patashala.

The averments in the affidavit filed in support of the writ petition would disclose that so far no coercive action is taken against the petitioners. If what is contended by the petitioners is true that the assignment was granted to them and those assignments were not cancelled, what is alleged now is nothing but an apprehension and the writ petition is a pre-emptive litigation to stop the competent authority from taking appropriate course of action as available to him. It is also pertinent to note that even the assigned land can be reclaimed by the Government after following the due procedure.

Thus, granting liberty to the petitioners to avail appropriate remedies as available in law as and when the cause of action arises, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
