HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER CRIMINAL PETITION No.56 OF 2017 ORDER:

The present Transfer Criminal Petition, under Section 407 of the Code of Criminal Procedure, 1973, is filed requesting to withdraw C.C.No.804 of 2015 from the file of IV Additional Junior Civil Judge, Guntur, and transfer the same to the file of V Additional Judicial Magistrate of First Class, Nellore.

2. Heard learned counsel for the petitioner.

3. Though, notice was served on respondent No.2 - de facto complainant, none appears.

4. Irrespective of the reasons mentioned in the affidavit filed in support of the petition, since one of the local courts would entertain the Calendar Case, the request is acceded to and C.C.No.804 of 2015 pending on the file of IV Additional Judicial Magistrate of First Class- cum - Junior Civil Judge, Guntur, is withdrawn and transferred to the file of V Additional Judicial Magistrate of First Class - cum - Junior Civil Judge, Nellore.

5. Accordingly, the present Transfer Criminal Petition is allowed. Miscellaneous Petitions, if any, pending in this Transfer Criminal Petition, shall stand closed.
