These Criminal Petition is {iled under Section 438 Cr.p.C. seeking pre-arrest bail to petitioners, who are arrayed as accused Nos. 1 and 2 in the event of their arrest in connection with Crime 42 of 2022 of Rein Bazar Poiice Station, registered for the offences punishable under Sections 406 and 42O of Indian Penal Code.

Heard learned counsel for petitioners and learned Assistant Public Prosecutor for the respondent-State. 3.
Since the punishment prescribed for the offences alleged against petitioners is up to seven years, without going into merits of the matter, respondent - Police are directed to follow the procedure as contempiated under Section 41-A Cr.p.C and the guidelines formulated by the Hon'ble Supreme Court in Antesh Kumar a. Considering the age of the petitioners, who are aged 78 and 80 years respectively, the police are directed not to arrest the petitioners during the investigation.
