THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No. 85 OF 2013 O R D E R :

The Company Petition was admitted on 24.01.2014 with a further direction to cause publication of the advertisement in Form No. 48 of the Companies (Court) Rules, 1959 in Business Standard and Andhra Prabha daily newspapers of Srikakulam District Edition.

On 12.07.2018, this Court had recorded that there was no representation on behalf of the petitioner, so also there is no material on record to show that the petitioner had caused publication of the advertisement. In those circumstances, the Company Petition was directed to be listed under the caption 'for dismissal'. Thereafter, the matter came up on 19.07.2018. A further request was made to adjourn the matter by two more weeks.

Even today, there is no representation on behalf of the petitioner. In those circumstances, it is presumed that the petitioner is no more interested in pursuing the matter. The Company Petition is therefore, dismissed for non-prosecution. No costs.
