While upholding the decision impugned in W.P.No.4562 of 2019, the writ petition was disposed of, granting liberty to the petitioner to make fresh application placing before the competent authority with a self declaration on dependence as required and also declaration that no other family member is getting family pension. On filing such application along with declarations, the application be considered afresh notwithstanding the earlier rejection. Alleging violation of the said order, this contempt case is filed.

When the matter is taken up, learned Government pleader placed before this Court the Memo No.1537/AE2/Pen.Accts/2018 dated 05.08.2019, by which the claim of the petitioner is rejected.

Learned counsel for the petitioner sought to contend that though the order is passed as directed by the Court, but the same is not in tune with the requirement of Pension Rules, and even though petitioner is entitled to family pension as a disabled daughter of the deceased employee, illegally, the benefit is denied.

What is contended by learned counsel for the petitioner may be true, but that is not within the scope of contempt proceedings. Apparently, a decision was made in pursuant to the directions issued. The correctness of the decision cannot be gone into the contempt proceedings.

Accordingly, Contempt Case is closed, leaving it open to the petitioner to work out her remedies, if so advised, against the decision communicated by the Government. Pending miscellaneous petitions, if any, shall stand closed. __________________ P.NAVEEN RAO,J 7th February, 2020 Rds
