THE HON'BLE SRI JUSTICE M. LAXMAN CRIMINAL PETITION No.5092 OF 2023 ORDER:
The present petition is filed under Section 438 of the Code of Criminal Procedure (in short 'Cr.P.C.') by the petitioner-accused seeking grant of anticipatory bail in connection with crime No.361/2023 of P.S. Patancheru, Sanga Reddy District, registered for the offence punishable under Section 306 of Indian Penal Code.
2) The sum and substance of the case of the Prosecution is that the husband of the de facto complainant allegedly took a personal loan from IDFC Bank. On account of death of her mother-in-law, the husband of the de facto complainant could not promptly pay the EMIs. Thereafter, the officials of the Bank have started calling and sending messages from mobile number 7386354046 and on account of such threatening over the phone, the deceased had committed suicide.
3) Heard learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.
4) From the complaint, it is not clear as to what kind of threatening were made. Admittedly, there is a hand loan
transaction from the Bank. There may be demands to pay the amounts. But, that itself do not, prima facie, amount to abatement to commit suicide. In the said circumstances, this Court feels that the petitioner-accused can be extended the benefit of the anticipatory bail.
5) Accordingly, the Criminal Petition is allowed on the following terms and conditions:
(i) The petitioner/accused shall be enlarged on bail in the event of her arrest in connection with FIR No.361 of 2023 on the file of the Station House Officer, Patancheru Police Station, Sanga Reddy District, on her executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties to the like sum each to the satisfaction of concerned Station House Officer.
(ii) The petitioner/accused shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C and co-operate with the Investigating Officer in investigating the case. ______________________ JUSTICE M. LAXMAN Date : 19.06.2023 sur/mmr
