THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 5140 of 2015 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) This petition for writ of Habeas Corpus has now become infructuous in view of the fact, which could be found in the counter affidavit, that the alleged detenu was arrested in connection with a criminal case and then he was produced before the appropriate Magistrate, who has remanded him to judicial custody. According to the learned counsel for the petitioner, the detention of the alleged detenu for longer period was unauthorized, as he was arrested long time back and he was produced much later. We are of the view this cannot be gone into by this Court in this petition. It is open for the person, who is affected by the prolonged detention, to take action in accordance with law. The Writ Petition is accordingly dismissed as infructuous. Pending miscellaneous petitions, if any, shall also stand dismissed. No costs.
