HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.30779 of 2015 ORDER:

Heard.

The petitioner is aggrieved by the proceedings of the 4th respondent, dated 16-06-2015 stating that in Sy.No.187 only land admeasuring Ac.0-28 gts., is available. The petitioner disputes the said statement, as it is contrary to the earlier survey conducted by the Mandal Surveyor on 06-02-2012. It is, however, evident from the impugned order itself that on the basis of the spot enquiry, the said proceeding is issued and it is stated that after completion of survey, the 4th respondent would furnish land extent, survey number and pattadar details. The said proceeding, therefore, is only a report on the spot inspection made by the 4th respondent addressed to the 2nd respondent for information. As the 4th respondent stated that he would furnish the details, as stated above, after completion of survey, no cause of action as on today exists for the petitioner to question the impugned order. Accordingly, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
