HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO SECOND APPEAL No.436 of 2018 JUDGMENT :

Heard both sides and perused the order and decree of the Courts below and the grounds of appeal urged in the second appeal. 2.

In fact, there are no substantial questions of law involved to admit the second appeal.

Hence, the second appeal is disposed of rather than dismissal, by granting time of one year till end of April, 2019, to vacate the premises and in the meantime to pay damages for use and occupation at Rs.6,000/- (Rupees six thousand only) per month from October, 2006, onwards till end of March, 2018, and from 01.04.2018 till vacating the premises by end of April, 2019, at Rs.20,000/- (Rupees twenty thousand only) per month. Any non-payment for continuous two months entitles execution of the decree to take delivery of possession in the meantime. Twelve (12) weeks time is granted to pay all the arrears.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
