THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.14880 OF 2017 ORDER:

Petitioner claims that she is the wife of the fourth respondent, who is an employee in the respondent-Corporation and that her husband is not looking after her welfare. According to her, her husband is in the process of taking voluntary retirement and withdraw all the retirement benefits. She complains that her husband is not giving monetary assistance to her. Therefore, she requests that her name to be reflected as nominee in the service records of her husband and further claims that at least 50% of the retirement benefits payable to her husband should be withheld.

The entries in the Service Record are based on the declarations given by the employee and as per the assessment by the employer. No third party to such Service Record can either claim any changes in the Service Record or seek mandate against the employee on the employer to withhold the benefits payable to the employee. If the petitioner is the wife of the fourth respondent and she has any grievance with him, she has to independently work out her grievances. She cannot compel the employer to act against an employee merely because he is her husband.

The Writ Petition is not maintainable and is, accordingly, dismissed leaving it open to the petitioner to work out her remedies as available under law. There shall be no order as to

costs. Miscellaneous petitions, if any, pending shall stand dismissed.
