Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner was appointed as a Fair Price Shop Dealer in Madhupam village, G.Sigadam Mandal, Srikakulam District in the year 1984. While so, the shop of the petitioner was inspected on 5.6.2015 by the Inspector of Vigilance and Enforcement Department, Srikakulam and seized the entire stock in the shop on the ground that there are marginal variations in the stock. Based on the report submitted to the Revenue Divisional Officer on 8.6.2015, 6-A proceedings were initiated against the petitioner. Simultaneously, the third respondent issued show cause notice on 12.06.2015 for the
variation in the stock. The petitioner submitted his explanation to the said show cause notice. The Joint Collector, Srikakulam, also issued show cause notice to the petitioner on 23.6.2015 and 6-A proceedings are pending. Though the authorization of the petitioner is subsisting and in force, no stock was released to the petitioner's FP shop for the month of June, 2015. Questioning the same, the present Writ Petition is filed. The learned Counsel for the petitioner submits that no stock of essential commodities for the month of June, 2015 is released to the petitioner's FP Shop despite the authorization is subsisting as of today and no action was taken by the third respondent pursuant to the show cause.
In the circumstances, respondents 3 and 4 are directed to release the essential commodities to the petitioner's Fair Price Shop provided the authorization of the petitioner is subsisting and in force.
Subject to the above, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
