HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO. 1964 OF 2015 ORDER:

At the admission stage, the following order is passed.

The allegations in FIR against petitioners/accused, who are partners of Sudha Rice Mills, Amruthalur Village, Guntur District, are that the accused in the rice mill are securing PDS rice illegally, polishing and selling at high price. On 9.1.2015 the authorities have inspected the rice mill premises and found PDS rice stored in the rice mill. Hence, the FIR for the offences under Section 7 of Essential Commodities Act and Section 420 of IPC. Having regard to the prima facie nature of accusation, it is not a fit case to quash the proceedings. However, considering the submission of learned counsel for petitioners that some of petitioners/accused are aged and the stock was already seized by the authorities, the police of Amruthalur Police Station, Guntur District, are directed not to arrest the petitioners/accused during the course of investigation. Petitioners/accused are directed to cooperate with the investigating agency for smooth completion of investigation.

Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
