Petitioner is a fair price shop dealer of shop No.3920 of Venkatraopalli village, Boinpalli Mandal, Karimnagar District. The petitioner's authorisation was however suspended by the impugned order passed by the second respondent on 09.01.2015 on which date the petitioner was served with show cause notice without giving any time to him for submitting his explanation. However, the petitioner has submitted his detailed explanation to the said show cause notice and the same was acknowledged by the second respondent on 16.01.2015.
Petitioner states that the authorisation was suspended even without getting the explanation from him merely on the basis of the report of Tahsildar, which is wholly unjustified. Petitioner also states that there is no shortage of stock and there is no allegation adverse to him that he is doing any clandestine business. However, these are all the matters which are to be appreciated by the second respondent after considering the explanation of the petitioner.
In my view, it is therefore appropriate to dispose of the writ petition directing the second respondent to consider the explanation of the petitioner with response to the show cause notice and pass appropriate orders.
Accordingly, the Writ Petition is disposed of directing the second respondent to consider the explanation submitted by the petitioner and pass appropriate orders with response to the show
cause notice within a period of two weeks from the date of receipt of copy of this order. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date:28-01-2015 Note: Issue C.C.within three days.
