This petition is filed under Section 24 of C.P.C. seeking to withdraw D.V.C.No.3 of 2018 from the file of the Additional Judicial Magistrate of First Class-cum-Mobile Court-cum-Special Court under the Protection of Women from Domestic Violence Act, 2005, Anantapuram, and transfer the same to the file of the Family Court, Kurnool.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to dispense with the presence of the petitioner before the Additional Judicial Magistrate of First Class-cum-Mobile Court-cum-Special Court under the Protection of Women from Domestic Violence Act, Anantapuram, on each and every date of adjournment.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the presence of the petitioner in D.V.C.No.3 of 2018 on the file of the Additional Judicial Magistrate of First Class-cum-Mobile Courtcum-Special Court under the Protection of Women from Domestic Violence Act, Anantapuram, is dispensed with on each and every date of adjournment. However, he shall appear before the trial Court as and when his presence is so required. 5.

With the above observation, the Transfer Civil Miscellaneous Petition is disposed of. There shall be no order as to costs.
