THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10176 OF 2016 ORDER:
Petitioners' case is that 1st petitioner purchased an extent of Ac.1.58 cents in survey No.39/1 of Kommadi Village, Madurawada Sub Division within the jurisdiction of Chinnagadili, Visakhapatnam District under a registered sale deed dt.19.06.1996 vide document No.630/1996 from one Reddy Appala Murthy. Similarly, one Smt Late Meruva Shoba Devi purchased an extent of Ac.1.58 cents of land in survey No.39/1 of the same village from the said Reddy Appala Murthy under registered sale deed dt.19.06.1996 vide document No.629/1996 and after her death, her husband, son and daughter, who are petitioners 2 to 4 herein, inherited the said land. Further 5th petitioner obtained possession under advance receipt to the property to an extent of Ac.1.60 cents in survey No.39/1 of the same village from the very same Reddy Appala Murthy.
All the petitioners are in possession and enjoyment of their respective lands. While so, on 21.03.2016 4th respondent along with his staff attempted to dispossess the petitioners forcibly without issuing any prior notice or without following any procedure. Aggrieved by the same, the present Writ Petition is filed.

Heard counsel for the petitioners and the Assistant Government Pleader for Revenue appearing for the respondents.
3. Learned Assistant Government Pleader states that if they want the petitioners' lands, they will follow the due process of law before initiating any action against the petitioners.
4. In view of the said submission, the Writ Petition is disposed of directing the respondents not to dispossess the petitioners from the
above lands without following due process of law. There shall be no order as to costs.
5. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
