THE HON'BLE JUSTICE G.SRI DEVI Criminal Petition No.3892 of 2019 ORDER:
This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners/Accused Nos.8 and 16 seeking to quash the proceedings in C.C.No.1427 of 2017 on the file of the Judicial Magistrate of First Class at Manthani, for the offence punishable under Sections 409, 464, 420, 468 and 471 read with 34 IPC.
2. Though the present Criminal Petition is filed seeking quashing of proceedings in the above-said Calendar Case, at the time of hearing, learned counsel for the petitioners restricts his prayer seeking dispensation of the appearance of the petitioners before the trial Court.
3. The learned Additional Public Prosecutor submits that since the identity of petitioners is not in dispute in the present case, the presence of the petitioners in the above C.C. may not be necessary on each and every date of adjournment.
4. Having regard to the facts and circumstances of the case and considering the rival submissions, the personal appearance of petitioners/accused Nos.A.8 and A.16 in C.C.No.1427 of 2017 on the file of the Judicial Magistrate of First Class at Manthani is hereby dispensed with except on the dates specifically warranted by the trial Court.
5. Accordingly, the Criminal Petition is disposed of.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
