THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11555 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents No.3 to 6 police personnel in interfering the civil disputes between the petitioners and respondent NO.7 and also interfering with the peaceful possession of the petitioners property without any legal cause as illegal, arbitrary and violation of Articles 19, 21 of the Constitution of India and consequently direct the respondents No.3 to 6 not to interfere with petitioners property an extent of 785 sq.yards, situated at D.No.280, Aravalli Village, Attili Mandal, West Godavari District by providing police protection to the petitioners from the threats of the respondent No.7."

Heard Sri Ch. Jayakrishna, learned counsel for the petitioners and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.

Today, when the matter is called, written instructions, dated 24-04-2015 furnished by the Sub-Inspector of Police, Attili Police Station, West Godavari District have been placed on record by the learned Government Pleader for Home and the said instructions read as under: "... ... ...

It is respectfully submitted that one Velagala Mohan Reddy who is the 7th respondent herein approached Police Station on 26.03.2015 lodged complaint against Satti Padma Srinivas Reddy and another petitioners. After receiving the complaint, the respondent police gave a report vide No.29/2015, dt.26.03.2015 and advised them to approach concerned appropriate court while the matter is civil in nature. It is submitted that the respondent police did not interfere the petitioner's and respondent's land disputes, hence the allegations made by the petitioner are far from truth. It seems that the petitioner filed this writ petition as precautionary measures."

On noticing the above said instructions, learned counsel for the petitioners has requested this Court to dispose of the writ petition by recording the said instructions.

In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 24-04-2015 furnished by the Sub-Inspector of Police, Attili Police Station, West Godavari District. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. There shall be no order as to costs. ___________________ A.V.
