THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.7872 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) The Commissioner, Vizianagaram Municipality, is present. His personal appearance is dispensed with. He has given instructions to the learned counsel for the Municipality to submit that the revision appeal has not been received. However, we do not accept such statement to be correct, apparently as we find from the record
a document, which appears to be acknowledgment of receipt of such appeal. In that view of the matter, in order to avoid further controversy, we direct the learned counsel for the petitioner to submit a copy of the revision appeal to the appellate authority, who shall dispose of the same within thirty days from date. While deciding the revision appeal, an opportunity of hearing shall be given to the petitioner and a speaking order shall be passed. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
