THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.2044 of 2017 ORDER:

This criminal petition is filed to reduce the surety amount imposed by the Metropolitan Sessions Judge-cum-I Additional District and Sessions Judge, Visakhapatnam, in Crl.M.P.No.4226 of 2016 dated 14.12.2016 whereby the first petitioner/ A.1 shall be released on bail on execution of personal bond for a sum of Rs.1,00,000/ - with two sureties who shall furnish a fixed deposit of Rs.1,00,000/ - each to the satisfaction of Additional Judicial First Class Magistrate, Narsipatnam and the second and third petitioners/ A.2 and A.3 shall be released on bail on execution of a personal bond for a sum of Rs.50,000/ - each with two sureties who shall furnish a fixed deposit of Rs.50,000/ - each drawn in the name of the Court and submit the same to the satisfaction of Additional Judicial First Class Magistrate, Narsipatnam.

The main contention of the petitioners before this court is that the petitioners are agricultural coolies and not in a position to furnish fixed deposit for Rs.1,00,000/ - and 50,000/ -. Therefore, taking into consideration the financial capacity of the petitioners, fixed deposit for an amount Rs.1,00,000/ - and 50,000/ - is reduced to Rs.50,000/ - (Rupees Fifty Thousand Only) and Rs.25,000/ - (Rupees Twenty Five Thousand only) respectively by each of the petitioners.

With the above modification, the criminal petition is allowed.
