THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.14219 of 2019 ORDER:

Heard.

2. Petitioner claims to be the owner of house bearing No.1-98 in survey No.32/AA/11 of Tirmalapur Village, Gollapalli Mandal, Jagityal District. Petitioner alleges that neighbor to the petitioner owns agricultural land along with a well existing abutting to the wall of the petitioner's house. Petitioner alleges that three years ago he dug the well further deep and increased the depth and width of the well and it has now become very close to the house of the petitioner. There is every likelihood of breach of compound wall and in that case there is a threat to the property and life of the inmates of the house. So, he wants to take action against the neighbor.

3. No provision of law prohibits the owner of a well from further strengthening the well and no direction can be issued to the respondent-authority to intervene, at the instance of the petitioner, and prevent the owner of the well from further strengthening the well. Therefore, the relief sought by the petitioner cannot be granted. Leaving it open to the petitioner to work out his remedies available in law, the Writ Petition is dismissed.

Miscellaneous Petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
