HON'BLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No.1706 of 2011 ORDER:

This Criminal Petition is filed by the petitioners, under Section 482 Cr.P.C., seeking to quash the order, dated 08.02.2010, passed by the Sub-Divisional Magistrate, Tenali, in M.C.No.3 of 2010 and consequently to declare the order as lapsed.

The order under challenge was passed by the Sub-Divisional Magistrate and Revenue Divisional Officer, Tenali, in M.C.No.3 of 2010 on 08.02.2010 directing the petitioners herein and others to appear before the Court on 25.02.2010 at 11.00 A.M. at Sub-Collector's Office, Tenali, to show cause as to why they should not be called upon to execute bonds to keep peace in the village for a period of six months.

Learned counsel for the petitioners submitted that in compliance of the aforesaid order, the petitioners executed bonds to keep peace, under Section 107 Cr.P.C., for a period of six months and, accordingly, they appeared before the authority concerned as and when directed. He further submitted that though the period of six months expired on 08.08.2010, the authority concerned is summoning the petitioners to appear before him.

Admittedly, the said order becomes infructuous since the impugned order was passed on 08.02.2010 directing the petitioners to execute bonds to keep peace in the village only for a period of six months and the said period already expired on 08.08.2010. Accordingly, the Criminal Petition is allowed and the order dated 08.02.2010 passed by the Sub-Divisional Magistrate, Tenali, in M.C.No.3 of 2010, has become infructuous.
