THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3238 OF 2017 ORDER :

This writ petition is filed on the mere apprehension that the 4th respondent-Tahsildar, Peddacherlopalli Mandal, Prakasam District, is attempting to change revenue entries in respect of the petitioner's lands situated in Battupalli Village, Peddacherlopalli Mandal, without conducting enquiry and contrary to the provisions of the ROR Act.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for the respondents. Inasmuch as it is only an apprehension of the petitioner that the 4th respondent, without following the due process of law, would change the revenue entries in respect of the petitioner's land, and further as on today, no proceedings are issued in respect of the said lands by the 4th respondent, this writ petition is pre-mature and it is accordingly dismissed. However, it is made clear that before resorting to change the revenue entries in respect of the subject lands of the petitioner, it is obligatory on the part of the 4th respondent to issue notice to persons concerned, conduct enquiry and follow due process of law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed.
