THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20516 OF 2017 ORDER:
This writ petition is filed seeking to issue a writ of mandamus to declare the action of the 2nd respondent in not taking any action against 3rd respondent, pursuant to representation, dated 06.05.2017, for stopping illegal construction at Sy.Nos.1500, 1501, 1550 and 1551 of Korutla Municipality, Jagtial District, as illegal and arbitrary. Heard and perused the material available on record. The petitioner is a permanent resident of Korutla Town and residing in H.No.1-2-202, Jhansi Road, Korutla Town and Mandal, Jagtial District. The 3rd respondent is constructing a School building in Sy.Nos.1550, 1501, 1550 and 1551 by obtaining permission. But, the 3rd respondent is encroaching the passing-way and also the open plot left for public purpose and constructing the building.
The petitioner made an application under Right to Information Act to the concerned authority, through which he came to know that the 3rd respondent is making construction by encroaching the road and also the open plot left for public purpose. Therefore, the petitioner filed a representation on 06.05.2017 to the 2nd respondent requesting to take action against the 3rd respondent for encroaching the public road and the open plot. But, no action has been taken so far.
Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:
" The 2nd respondent is directed to consider representation, dated 06.05.2017, made by the petitioner, and take appropriate action in accordance with law regarding the alleged unauthorized constructions, within a period of eight (8) weeks from the date of receipt of a copy of this order."
With the above direction, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions pending if any, shall stand closed.
