O R D E R
The prayer of the petitioner in this case is as under: 'For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Hon'ble Court may be pleased to issue the Writ order or Direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents in calling the petitioner for the investigation without there being any crime registered or pending for investigation against the petitioner as arbitrary, illegal, capricious and violative of fundamental rights guaranteed under Article 14 and 21 of the Constitution of India and consequently direct the respondents not to deprive the life and liberty of the petitioner without following the due process of law and pass such other orders as may be deem fit and proper in the circumstances of the case.'
Written instructions dated 02.03.2016 were furnished by the SubInspector of Police, Nunna Police Station, Vijayawada City, stating that no complaint was received from or registered against the petitioner with the Nunna police station authorities and therefore, the question of calling the petitioner in the context of any investigation did not arise. The SubInspector also denied the allegation of the petitioner that she was called to the police station.
The aforestated stand of the police authorities is taken on record. In the light thereof, this Court finds no reason to entertain this writ petition for adjudication on merits. Sri Sai Gangadhar Chamarty, learned counsel for the petitioner, is also agreeable to closure of the writ petition recording the stand of the police authorities.
The writ petition is accordingly closed. Pending miscellaneous petitions shall also stand closed in the light of this final order. No order as to costs.
