HON'BLE SRI JUSTICE S.V. BHATT C.R.P.No.2744 OF_2018 ORDER:

The 3rd defendant in O.S.No.48 of 2004 is the revision petitioner.

The revision petitioner herein challenged the order in I.A.No.351 of 2017 in O.S.No.48 of 2004 in C.R.P.No.2350 of 2018. This Court vide separate order of even date allowed C.R.P.No.2350 of 2018. The legal effect of the order in C.R.P.No.2350 of 2018 is that the revision petitioner herein is not yet made as a party in O.S.No.48 of 2004.

The instant application I.A.No.142 of 2018 is filed for amendment of plaint.

Having regard to the view taken in C.R.P.No.2350 of 2018, the order in I.A.No.142 of 2018 is set aside. I.A.No.142 of 2018 is restored to file for consideration, subject to the outcome of prayer in I.A.No.351 of 2017.

Accordingly, the Civil Revision Petition is ordered. There shall be no order as to costs.
