ORDER
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "..to issue an order, writ or direction more particularly in the nature of Writ of Mandamus declaring the (a) action of the 1st respondent in rejecting the application filed with the petitioner No.1 seeking transfer of management of the petitioner No.2 college to the petitioner No.1 society vide the impugned proceedings No.SRO/NCTE/2009-2010/27066 dated 11.02.2011 as arbitrary and illegal (b) the action of the 1st respondent in withdrawing the recognition granted in favour of the 2nd petitioner college vide impugned proceedings No.SRO/NCTE/200910/14523 dated 13.07.2009 as arbitrary and illegal and issue a consequential direction to the respondents to continue the recognition to the petitioner NO.2 college for and from the academic year 2011-12 and pass such other order or orders".
2. Pending the writ petition, a miscellaneous petition in W.P.M.P.No.15267 of 2016 has been filed seeking the following relief;
"to direct the 1st respondent to consider the application of the 1st petitioner dated 24.02.2016 read with 29.02.2016 for change of management of the 2nd petitioner and for consequential restoration of recognition w.e.f. the academic year 2016-17 pending disposal of the writ petition".
3. It is submitted by the learned counsel for the petitioners that the applications dated 24.02.2016 and 29.02.2016 are pending with the respondents and the same may be directed to be disposed of without going into the merits of the matter by fixing some time frame.
4. Learned Standing Counsel for the respondents says no objection for the same.
5. In view of the same, the WPMP No.15267 of 2016 is allowed and the Writ Petition stands disposed of, directing the first respondent to consider the applications of the petitioner dated 24.02.2016 and 29.02.2016 and dispose of the same in accordance with law, within two months from the date of receipt of a copy of this order.
There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. ________________ A. V. SESHA SAI, J 27th June, 2016 sj
