O R D E R
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the 1st respondent - State. This criminal petition is filed to quash the proceedings in Crime No.262 of 2013 on the file of II Town Police Station, Maharanipeta zone, Visakhapatnam City, registered against the petitioner, who is A-11, for the offence punishable under Sections 120-B, 406, 420-B read with 34 IPC and Section 5 of A.P. Protection of Depositors of Financial Establishment Act, 1999 and Sections 4 and 5 of the Prize Chits and Money Circulation Scheme (Banning) Act, 1978.
The grievance of the petitioner who is shown as A-11 in the above said crime is that the allegations levelled in the complaint do not disclose involvement of the petitioner and they are made only against A-1, who is the managing director of the chit fund company, which committed default, and that the petitioner is also one of the victims and that though he was granted bail, the police are harassing him by frequently calling to the police station and as the allegations in the complaint do not disclose the involvement of the petitioner, sought to quash the proceedings. From a perusal of the material on record and the complaint reveals certain specific allegations and the matter requires to be investigated by police and the truth or otherwise of the allegations can only be decided during course of investigation or trial. I see no ground to interdict the
investigation at this stage and quash the first information report. In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the investigating agency to proceed with the investigation. However, it is made clear that the petitioner shall not be called to police station unnecessarily during the process of investigation and subject to harassment as alleged.
Miscellaneous petitions pending if any, shall stand closed. No costs.
