THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.11930 of 2018 ORDER:

In this Writ Petition, under Article 226 of the Constitution of India, the main grievance of the writ petitioner is with regard to non-filing of a final report after completion of investigation into the case in Crime No.190 of 2015, on the file of Pedakakani Police Station, Guntur Urban, Guntur District, as per the earlier directions, dated 10.11.2016, of this Court in W.P.No.37437 of 2015.

I have heard the submissions of Sri P.Bhaskar, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (A.P.) appearing for the respondents 1 to 3. I have perused the material record.

At the hearing, learned Government Pleader for Home, on written instructions, would submit that the investigation into the afore-stated crime has been completed and the investigation disclosed that the case is a false case and, therefore, necessary permission was sought from the superior Police Officer for filing a referred charge sheet and that on that, proceedings, dated 11.02.2018, were issued by the Sub-Divisional Police Officer, North Sub-Division, Guntur Urban, instructing to submit a final report along with served notice on the complainant before the Court concerned and obtain necessary proceedings within a week and that, therefore, the Officer, who investigated into the crime, is taking necessary steps, following the instructions afore-stated of the superior Police Officer. MSRM, J W.P.No.11930 of 2018 11.02.2018, of the Sub-Divisional Police Officer are placed on record after supplying a copy of the same to the learned counsel for the petitioner.

Learned counsel for the petitioner, in reply, would submit that liberty may be reserved to the petitioner to approach the Court of the learned Magistrate and seek the remedies, which the law permits.

Recording the submissions, the Writ Petition is disposed of, however, reserving liberty as sought for. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
