HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14286 OF 2019 ORDER:

This writ petition is filed to declare the action of respondents more particularly the 3rd respondent in not extending assistance to protect possession of the petitioners over the land admeasuring 1880 square yards situated at Sri Laxmi Narsimha Swamy Enclave, Datherpally Village, Yadagirigutta Mandal, Yadadri Bhongir District and for the implementation of orders in I.A.No.153 of 2017 in O.S.No.56 of 2017 on the file of V Additional District Judge, Bhongir as confirmed by this Court in CMA.No.88 of 2019, dated 29-032019 as illegal and arbitrary. After hearing argument of learned counsel for the petitioners for some time, it appears suits and cross suits are pending between the parties and their vendors and injunctions are operating in the suits. But learned counsel for the petitioners says that petitioners are not parties to the said suits. It is not a case as if the petitioners do not have alternative remedy for obtaining police protection by filing necessary application before the trial Court, wherein the trial Court can entertain the contentious issues.

In view of the contentious issues raised in the writ petition, without expressing any opinion on the merits of the case, the writ petition is disposed of granting liberty to the petitioners to approach the trial Court for grant of police

protection and on such application, the trial Court to consider the same and pass orders.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 07-08-2019 Nvl
