This Criminal Petition is filed seeking the Court to enlarge the petitioner on bail, who is arrayed as accused No.10 in Crime No.432 of 2026 of L.B. Nagar Police Station, Malkajgiri District, registered for the offences punishable under Sections 310(2). 331(4) and 311 of the BNS. 2.

The brief facts of the Prosecution case are that on 29-03-2026 at 14-30 hours, the complainant lodged a

complaint before the police stating that on the same day at 6-00 hours, he came outside his house and found his night shift watchman by name Suresh kumar stood trembling and on enquiry the watchman revealed that at 1-40 hours unidentified individual scaled the wall, held knife at his neck and threatened with dire consequences, took his phone and ordered him to open the gate. Some other unidentified individuals entered into the premises and directly proceeded to second floor and after some time returned and stated to him "kuch nai re" and fled away from the spot. Later the watchman went to inspect the second floor and discovered some lemons lying there and got terrified. The complainant further stated earlier two times also the similar incidents had occurred. Hence, the complainant requested to take necessary action. Basing on the same, the police registered a case for the above said offences.

Heard Sri Mohd Abdulrahman Hyder, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner herein is accused No.10 and he is innocent of the said allegations and there are no specific allegations against the petitioner. It is further submitted that, basing on the C.C. T.V Camera footage, they identified the petitioner herein and found that the petitioner herein has also participated in the said crime and he is in jail since 02.04.2026 and the material part of the investigation is already completed. It is further submitted that the custodial interrogation of the petitioner is not required. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations against the petitioner herein are serious and heinous in nature and A.5 is not yet arrested by the police and the investigation is not yet completed as on today. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner herein is arrayed as accused No.10 and he is in jail since 02.04.2026. As seen from the remand case diary, the prosecution witnesses, LWs 1 to 20 have already been examined. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned VIII Additional District and Sessions Judge, Ranga Reddy District, L.B.

nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
