These two petitions are filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the self-same petitioners/A.1 and A.2 in C.C.No.230 of 2015(Crl.P.No.9154 of 2015) and C.C.No.83 of 2015(Crl.P.No.9172 of 2015) on the file of the learned I Special Magistrate at Erramanzil, Hyderabad, seeking to quash the proceedings in the above cases which are outcome of a private complaints by the selfsame 2nd respondent-defacto-complainant, taken cognizance for the offence under Section 138 of the Negotiable Instruments Act(for short,'the Act')
2. Heard.
3. The so called impugning of the statutory requirement of personal service of notice given to the company and the Managing Director not separately but for one, is left open to raise in defence.
4. With the above observation, both these Criminal Petitions vide Crl.P.No.9154 and 9172 of 2015 are disposed of. Needless to say if the petitioners file any application under Section 205 of Cr.P.C. to represent through special vakalath holder for himself on behalf of the A.1-entity, the learned Magistrate shall hear and grant with necessary conditions unless personal appearance is required for any particular adjournments. Consequently, miscellaneous petitions, if any, pending in these Criminal Petitions shall stand closed.
