THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.40800 of 2015 ORDER:

The grievance of the petitioner was that the police authorities were not investigating Crime No.287 of 2015 on the file of the II Town Police Station, Vijayawada, Krishna District. According to the petitioner, the crime was registered on 25.08.2015, but the police authorities were not taking necessary steps in the matter. The Sub Inspector of Police, Vijayawada II Town Police Station, furnished written instructions dated 28.01.2016 to the office of the learned Government Pleader for Home, wherein he stated that basing on the complaint made by the petitioner, Crime No.287 of 2015 had been registered under Sections 434, 447 and 506 I.P.C. read with Section 34 I.P.C. on the file of II Town Police Station, Vijayawada City.

However, after due investigation, wherein six witnesses were examined, the police authorities came to the conclusion that the case was 'False'. According to the Sub Inspector, the attempts to serve notice upon the petitioner as to the final report proposed to be filed came to naught as he refused to take the same. The final report referring the case as 'False' was stated to have been filed before the criminal Court concerned under C.F.No.850 of 2016. In the light of the aforestated developments, the grievance of the petitioner as to the alleged inaction on the part of the police authorities in investigating Crime No.287 of 2015 on the file of Vijayawada II Town Police Station, stands settled.

If he is aggrieved by the final conclusion arrived at by the police authorities, he necessarily has to take recourse to appropriate remedies in accordance with law. Reserving liberty to the petitioner to do so, the writ petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
