In this writ petition, petitioners challenge the auction notice, dated 12.06.2009, issued by the respondent.
While admitting the writ petition on 26.06.2009, this Court directed the respondent to conduct the proposed auction, but made it clear that the same would be subject to the result of the writ petition and the petitioners were given liberty to participate in the auction.
In the counter-affidavit filed by the respondent, it is asserted that pursuant to the impugned notice, auction was conducted and the petitioners did not choose to participate in the same. It is further asserted that since the structural condition of shop bearing Nos.10 to 15, out of 27 shops, is bad, the same were not included in the auction. It is also asserted that the lease cannot be granted for a period exceeding three years without prior sanction of the Government and that the petitioners are in occupation of the shops.
In may be noted that the impugned notice was issued for the purpose of allotting shops only for one year between 2009 and 2010. In as much as the period of auction has already expired and since the petitioners did not choose to participate in
the auction, no further orders are required to be passed in this writ petition.
Hence, the writ petition is dismissed as infructuous. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:11.10.2018 kdl
