THE HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.25447 of 2016 ORDER:
This writ petition is filed seeking to (1) declare the charge sheet dated 11th May, 2015 as illegal and arbitrary, (ii) declare that the enquiry conducted in pursuance of the charge sheet dated11-5-2015 is in violation of principles of natural justice; (iii) declare the findings of the enquiry authority dated 22nd April, 2016 communicated to the petitioner vide proceedings dated 13th May,2016 is in violation of principles of natural justice and fair play; (iv) declare the proceedings dated 24th June,2016 of dismissal from service issued by the respondents to the petitioner is illegal, arbitrary and unjust and consequently set aside the same and (v) direct the respondents to reinstate the petitioner into service with all consequential benefits including arrears of salary.
Since there is an appeal remedy available and in the circumstances, the petitioner is permitted to avail the said remedy within a period of 30 days from the date of receipt of a copy of this order.
It is needless to observe that the petitioner is entitled to raise all pleas that are available under law in the appeal to be preferred and the appellate authority shall consider the same. Accordingly, this Writ Petition is disposed of. No costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
