HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 19739 OF 2011 ORDER:
The present Writ Petition came to be filed seeking to declare the inaction of the respondent in disposing of the appeal in A.I.A.No.3 of 2005 (RC No.4912 of 2005), filed by the father of the Writ Petitioner as illegal and arbitrary.
Heard learned counsel for the petitioner and learned Government Pleader for Revenue.
The grievance of the petitioner appears to be that the appeal filed by her father had undergone several adjournments prior to his death, and inspite of the best efforts made by the petitioner, the appeal is not posted for hearing. Hence, this Writ Petition. Learned Government Pleader, on instructions, submits that the appeal is still pending.
Having regard to the circumstances stated above, the respondent herein is directed to dispose of the appeal in A.I.A.No.3 of 2005 (RC No.4912 of 2005), within a period of eight (08) weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
