THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.15476 OF 2014 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Prosecutor requesting to quash the FIR in Crime No.257 of 2014 on the file of Chikkadpally Police Station, Hyderabad. Learned counsel for the 2nd respondent submits that the petitioners have obtained anticipatory bail on 24.12.2014 in Crl.M.P.No.4565 of 2014 in the aforesaid crime from the Court of the I-Additional Metropolitan Sessions Judge at Hyderabad. In support of his submission, he produced a copy of the order of the said anticipatory bail obtained by the petitioners. Be that as it may, the learned Additional Public Prosecutor for the State of Telangana would represent that the Investigating Officer has filed a report on 22.05.2016 before the concerned Magistrate requesting permission to close the matter, as it is civil in nature.

In such an event, this Court cannot either usurp the power of the learned Magistrate granting permission or otherwise or to take away the right of filing a protest petition available to the defactocomplainant. But, however, in view of the report filed by the Investigating Officer, the present petition has to be disposed of.

Accordingly, the Criminal Petition is disposed of as infructuous.

Miscellaneous Petitions, if any, pending in this petition, shall stand closed.
