THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 25646 OF 2017 O R D E R:

This Writ Petition has been filed questioning the action of the 3rd respondent police in not assisting and giving the police protection for removal of the encroachments made by the respondents 4 and 5 by erecting a bunk in the Chtagotia Gram Panchayat site in Sy.No.69-1 admeasuring Ac.0.04 1⁄2 cents earmarked for construction of water plant. Learned Government Pleader for Home, had placed on record the written instructions received from the Sub Inspector of Police & SHO, Podalakur P.S., SPS Nellore District wherein it is stated that "pursuance of the above request, myself along with my staff visited the spot on 29.7.2017 and provided police protection to the Panchayat Secretary, Chatagotla Groam Panchayat, for removal of encroachments of the respondents 4 and 5 herein in the presence of Tahsildar, Dy.

Tahsildar, Surveyor concerned and their staff on 29.7.2017. The photograph of site evidencing their removal of encroachment on 29.7.2017 is enclosed herewith and thus the allegation of the petitioner that the 3rd respondent police is not assisting and giving protection for removal of the encroachments made by the respondents 4 and 5 by erecting a bunk in the site in question for construction of water plant, is absolutely false and baseless."

Along with the written instructions, photograph evidencing the removal of the obstruction of the bunk has also been filed. In that view of the matter, as the relief claimed by the petitioner stands granted, the writ petition is liable to be closed.

The Writ Petition is accordingly, closed. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
