This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973, for grant of anticipatory bail to the petitioners-accused Nos. 1 to 9 in Crime No. 20 of 2018 of Thavanampalle Police Station, Chittoor District, registered for the offences punishable under Sections 147, 148, 341, 324 and 323 read with Section 149 of IPC and Section 3 (1) (r) (s) of SC, ST (POA) Act, 2015 (for short, 'the Act').

The specific allegation against the petitioners is that they armed with deadly weapons caused injuries on the body of the de facto complainant, who belongs to SC Community, while abusing him by touching his caste name. The above allegation would constitute offences punishable not only under IPC but also under the Act.

After arguing for awhile, learned counsel for the petitioners, however, has requested this Court to issue a direction to the police concerned to follow the procedure laid down by the Apex Court in Dr . Su bash Kash in at h Mah aj an Vs. St at e of Mah ar ash t r a 1 if applicable. 4.

In view of the request made by learned counsel for the petitioners, the Station House Officer, Thavanampalle Police Station, Chittoor District, is hereby directed to follow the procedure laid down by the Apex Court in Dr . Su bash Kash in at h Mah aj an (supra) if applicable. 1 2018 L.S. (SC) 233

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions if any shall stand closed in consequence.
