The Court made the following:
ORDER:
Matter concerning non payment of compensation though property of the petitioner was acquired. This Court while disposing of the writ petitioner directed to explore the possibility of settlement of the issue amicably and if issue cannot be settled, to take up land acquisition proceedings in accordance with Act 30 of 2013. Alleging that the order of this Court was not complied with, this Contempt case is filed.
2. Learned Government Pleader submits that land acquisition proceedings in accordance with Act 30 of 2013 were taken up and appropriate compensation payable to the petitioner was determined and paid to the petitioner and order of this Court was complied with.
3. Learned counsel for petitioner submits that even though structure was existing, award was passed as if there is no structure existing and there is an error in calculation of determination of compensation.
4. This Court has not dealt with the issue of extent of property, on existence of structures and also the amount of compensation payable. This Court only directed to follow the procedure in accordance with Act 30 of 2013 and same is admittedly followed. If petitioner disputes amount of compensation determined or non payment of compensation for structures that were existing, he has to work out his grievance independently.
5. The orders of this Court are complied with and accordingly the contempt case is closed, granting liberty to the petitioner to work out his remedies on the award passed by the respondent authority, if so advised. No costs.
