THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.3621 of 2022 ORDER:

This Criminal Petition under Section 438 Criminal Procedure Code is filed by petitioners 1 to 3, who are arrayed as accused Nos.1 to 3, seeking bail in the event of their arrest in connection with Crime No.18 of 2022 of Komararam Police Station, registered for the offences punishable under Section 306, 294-B r/w.34 of Indian Penal Code and Section 4 of Dowry Prohibition Act.

Heard the learned Counsel appearing for the petitioners and learned Assistant Public Prosecutorrespondent, for the State. 3.
The case of the prosecution is that, the deceased was in love with the 1st petitioner over period of a four years, While they were in relation, the 1st petitioner alleged to have abused the deceased in filthy language when marriage proposal was made. Further the 1st
petitioner informed that he would get 20 Lakhs dowry if he marries someone else. In the said process, petitioners 2 and 3, who are father and brother of the 1st petitioner, alleged to have supported the 1st petitioner. In said circumstances, the prayer of 1st petitioner for grant of anticipatory bail is dismissed. 4.
In the facts and circumstances of the case, petitioners 2 and 3, who are father and brother of the 1st petitioner, can be considered.
5. The Criminal Petition is, accordingly, allowed in part, and the petitioners 2 and 3/accused No.2 and 3 are granted anticipatory bail subject to the following conditions:
(1) The petitioners 2 and 3/Accused No.2 and 3 are directed to surrender before the Station House Officer, Komararam Police Station, within ten days from the date of this order, and, on such surrender, the petitioners are directed to be released on bail on their executing a personal bond to the tune of Rs.10,000/-
(Rupees ten thousand only) with two sureties to the like sum each to his satisfaction.
(2) The petitioners shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case as and when required.
(3) The petitioners shall appear before the concerned police, on every Sunday for a period of two months.

The petition in respect of the 1st petitioner/accused No.1 is dismissed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
