Heard Mr. G. Narendra Chetty, learned counsel for the petitioner. Mr. S. Suribabu, learned special standing counsel for Commercial Taxes (AP), takes notice for the respondents. 3.

The order of assessment has already been set aside by us, by an order passed today in W.P.No.12677 of 2017. Therefore, following the same, this Writ Petition is allowed and the impugned order is set aside. However, we make it clear that if a fresh order of assessment is passed and if any liability arises thereunder, it may be open to the 1st respondent to proceed, in accordance with law.
