This Criminal Petition is filed by the petitioner/accused No.1 seeking release of his Bolero Goods Vehicle bearing registration No.TS 03 UB 5316, which was seized in connection with Crime No.57 of 2017 on the file of P.S.Maripeda, Warangal District. The learned Public Prosecutor takes notice for the respondent. Heard the learned Counsel for the petitioner and perused the record.

The petitioner filed Crl.P.No.234 of 2017 before the I Additional Sessions Judge, Warangal, for release of the aforesaid vehicle, but the same was dismissed on the ground that the vehicle was allegedly used in commission of an offence, which is grave in nature.

The learned Counsel for the petitioner contends that the petitioner was not found on the spot, but, his vehicle was used for the commission of the offence without his knowledge. In my opinion, seizing the vehicle and keeping it idle would serve no purpose, except the vehicle getting damaged. Hence,

TR, J Crl.P.No.8487 of 2017 Dt: 03.10.2017 Order, dated 23-06-2017, in Crl.M.P.No.234 of 2017 on the file of the I Additional Sessions Judge, Warangal, is set aside and the vehicle in question is directed to be released in favour of the petitioner, subject to his executing a personal bond for sum of Rs.1,50,000/- (Rupees One lakh fifty thousand only) with two sureties for a likesum each to the satisfaction of the I Additional Sessions Judge, Warangal.

Subject to the above direction, the Criminal Petition is allowed.
