HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.1 1 9 3 8 of 2 0 1 8 ORDER: - When the matter is taken up, it is submitted by the learned Counsel appearing for the petitioner that despite making a representation, as long back as on 22.03.2018, to the District Collector, Prakasam District/2nd respondent, no action has been taken sofar. It is submitted by the learned Counsel appearing for the petitioner that the action complained is in violation of the Orders of the State Government issued vide G.O.Ms.No.18, Transport, Roads & Buildings (Roads-1) Department, dated 18.02.2013. Paragraph Nos.2 to 4 of the said G.O.

read as under:- "In the reference second read above, the Supreme Court of the India, have passed the following orders;- "We further direct that henceforth, State Government shall not grant any permission for installation of any statue or construction of any structure in public roads, pavements, sideways and other public utility places. Obviously, this order shall not apply to installation of high mast lights, street lights or construction relating to electrification, traffic toll or for development and beautification of the streets, highways, roads etc., and relating to public utility and facilities. The above order shall also apply to all other States and Union Territories. The concerned Chief Secretary/Administrator shall ensure compliance of the above order."

In pursuance of the orders of the Hon'ble Supreme Court of India, Government hereby decide not to grant permission for installation of any statue or construction of any structure in public roads, pavements, sideways and other public utility places.

All the State Level and District Level Officers mentioned in the address entry are requested to ensure strict compliance of the above orders of Hon'ble Supreme Court of India."

Since the representation submitted by the petitioner herein is pending consideration before the District Collector/2nd respondent, this Court deems it appropriate to dispose of the Writ Petition with a direction to the District Collector/2nd respondent to take appropriate action on the said representation, dated 22.03.2018 keeping in view of the instructions issued by the State Government vide G.O.Ms.No.18, Transport, Roads & Buildings (Roads-1) Department, dated 18.02.2013, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs.
